I'm confused by this. Have ALUGgers been granted "prior written consent" to copy it "for a fair fee," as in "It is forbidden to reproduce or distribute data carriers which have been reproduced without authorisation for payment without the prior written consent of SUSE LINUX AG or SUSE LINUX"? Given that ALUG membership is open to all, that's a truck-sized loophole. Why don't they just change the licence? Or is this permission the sort that comes in an email with a fotter saying "nothing in this email is binding in court"?
