If anyone's wondering, Mandrake are only allowing MandrakeClub members to download the ISOs but everything's under GPL or compatible licenses so yes, I am allowed to distribute them. Paying your subs to the 'Club will make you a better, happier, healthier, and more attractive person though.
I've been wondering about this; will MDK10.0 OE *ever* be available for public download? Or is it only going to be the CE's from now on? (I couldn't find out from MDK's website).

With the last release it was available to the club members for something like a month before it was available for free download. I would think that if Mandrake decided to release CE versions only in the future they would have a certain method to reintroduce their financial problems and newbies would never be able to try out their distro without paying for it.
FWIW I like the Mandrake club idea and certainly think its a good way of getting funds in for the distro, but I am still not that enamoured by the distro (especially the first release of 9.2!) :)
